A&B Boxing LLC AGREEMENT OF RELEASE AND WAIVER OF LIABILITY

It explains the risks you are assuming by beginning an exercise program within A&B Boxing. It is critical that you completely understand the document, please read completely. After you have read and understood the document please print your name legibly and sign in the spaces provided at the bottom confirming you understand and agree to this waiver.
Waiver, Informed Consent and Covenant Not to Sue: I have volunteered to participate in a program of physical exercise under the direction of A&B Boxing/A&B Boxing LLC located at 1019 Petaluma Hill Rd #30, which will include but may not be limited to weight and/or resistance training. In consideration of A&B Boxing/A&B Boxing LLC agreement to instruct, assist and train me, I do hereby and forever release and discharge and hereby hold harmless A&B Boxing/A&B Boxing LLC and their respective agents, volunteers, heirs, assigns, contractors and employees from any and all claims, demands, damage, rights of action or causes of action, present or future arising out of or connected with my participation in this or any exercise program including any injuries resulting therefrom.
THIS WAIVER AND RELEASE OF LIABILITY INCLUDED WITHOUT LIMITATION, INJURIES WHICH MAY OCCUR AS A RESULT OF (1) MY USE OF ALL AMENITIES AND EQUIPMENT IN A&B BOXING FACILITIES OR PREMISES AND MY PARTICIPATION IN ANY ACTIVITY, CLASS PROGRAM, PERSONAL TRAINING OR INSTRUCTION (2) EQUIPMENT THAT MAY MALFUNCTION OR BREAK (3) THEIR NEGLIGENT INSTRUCTION OR SUPERVISION (4) ANY SLIPPING AND/OR FALLING, DROPPING OF EQUIPMENT WHILE ON A&B Boxing/A&B Boxing LLC PREMISES INCLUDING ADJACENT SIDEWALKS
AND PARKING AREAS.
Assumption of Risk To the best of my knowledge, I am in good physical condition and have no disease, physical limitation, health coverage or injury that would be aggravated or would be the cause of any injury sustained before during or as a result of my participating in activities related either directly and/or indirectly to A&B Boxing/A&B Boxing LLC.
I recognize that exercise might be difficult and strenuous and that there could be dangers inherent in exercise for some individuals. I acknowledge that the possibility of certain unusual physical changes during exercise does exist. These changes include abnormal blood pressure; fainting; disorders in heartbeat; heart attack; and, in rare instances, death.
I understand that as a result of my participation in an exercise program, I could suffer an injury or physical disorder that could result in my becoming partially or totally disabled and incapable of performing any gainfulemployment or having a normal social life.
I recognize that an examination by a physician should be obtained by all participants prior to involvement in any exercise program. If I have chosen not to obtain a physician’s permission prior to beginning this exercise program with A&B Boxing/A&B Boxing LLC, I hereby agree that I am doing so at my own risk. In any event, I acknowledge and agree that I assume the risks associated with any and all activities and/or exercises in which I participate. I acknowledge and agree that no warranties or representations have been made to me regarding the results I will achieve from this program. I understand that results are individual and may vary.
I ACKNOWLEDGE THAT I HAVE THOROUGHLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. BY SIGNING THIS DOCUMENT IN PERSON OR REMOTELY VIA ONLINE FORM. I AM WAIVING ANY RIGHT I OR MY SUCCESSORS MIGHT HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST A&B BOXING / A&B Boxing LLC. FOR YOUR NEGLIGENCE OR THAT OF YOUR EMPLOYEES, VOLUNTEERS, AGENTS OR CONTRACTORS.
PHOTO/MEDIA RELEASE FORM
By signing up for classes or events, the attendee grants A&B Boxing/ A&B Boxing LLC (permission to use his/her likeness in a photograph and/or video in any and all publications and materials without payment or consideration made to them. The attendee realizes these photos and/or videos become the property of A&B Boxing/ A&B Boxing LLC and will not be returned. The attendee authorizes A&B Boxing/A&B Boxing LLC to use, edit, copy, publish or exhibit any photo or video for any lawful purpose. The attendee waives the right to review any photo or video or to obtain royalties from the photo or video.
Please Note: Photos and videos will be taken throughout the day and some photographs/videos will be posted on our website and social media outlets.
I hereby grant the A&B Boxing/A&B Boxing LLC permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all photos will become the property of A&B Boxing/A&B Boxing LLC and will not be returned. I hereby irrevocably authorize A&B Boxing/A&B Boxing LLC to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo. I hereby hold harmless, release, and forever discharge the A&B Boxing/A&B Boxing LLC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
I HAVE READ AND UNDERSTAND THE ABOVE PHOTO RELEASE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENTS/GUARDIANS AS EVIDENCED BY THEIR SIGNATURES BELOW. I ACCEPT:
A&B Boxing - Auto Payment Agreement
1. 5 Day Right of Rescission – Member has Five (5) days from the first day of membership to cancel this Agreement in accordance with paragraph 2 without penalty or any additional charge. Any membership fees paid by the member before their notice of cancellation shall be retained by A&B Boxing and shall not be refunded.
2. Cancellations – Member agrees that all requests for cancellations must be submitted through a Cancelation request form listed in our website under “Waivers”. Physical copies can additionally be found in the gym office. This form shall be filled out and submitted in person, scanned and emailed to AthleticBrotherhood@gmail.com or submitted via our online form found at anbboxing.com. No other methods (verbal, text, message, etc.) of notice for cancellation shall be valid. The member must submit the request for cancellation a minimum of fifteen (15) days before a renewal for cancellation request to be valid or the following monthly membership charge will be made and shall not be refunded.
3. Early Termination/Refunds – A&B Boxing will not refund any membership fees.
4. AUTO-DEBIT: By enrolling in an auto-debit contract, you authorize A&B Boxing LLC to,on a recurring basis, automatically charge the debit or credit card account you specified, for the monthly payments on your unlimited auto-debit plan associated with your account, on the billing due date. You understand and acknowledge that (1) A&B Boxing LLC will initiate transfers/charges pursuant to this authorization not to exceed the amount shown on your Membership Agreement and/or in connect with cancellation fees per the cancellation policy. A&B Boxing LLC may discontinue processing of recurring charges if it is unable to secure funds from your debit/card due to, but not limited to, insufficient or uncollected funds in the account or insufficient or inaccurate information provided; (2) If you are removed from class due to the circumstances as described, it may not be possible to place you back into the class for which you were originally
